It’s astounding to me that from such self-appointed moralists in power, the debate isn’t “Should it be legal” but “How much torture should be legal.” I’m sorry, make that “detainee interrogation.” And a compromise with the president always ends up giving ground that so many have fought for.
It seems to me, that if I wanted to promote democracy and freedoms abroad, I would do my best to promote it domestically, and to also treat every human being on the planet (however despicable) as if they were citizens of the United States, with all freedoms and privileges.
I’d also be doing unto others as I would be done.
And if I were going to torture someone, I certainly wouldn’t want it to be easy, to be legal. I should have to think many many time if it was worth the outcome; and if it is, then I should be willing to go to jail for my country.
And, if we have to change our laws, doesn’t that mean the terrorists won? Did the victims of 9-11 die so that we would undo 225 years of law?
Article II Section 3
[The president] shall take Care that the Laws be faithfully executed.

This Constitution ... shall be the supreme Law of the Land;
Fifth Amendment
No person ... shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law.
Eighth Amendment
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
